Sunday Sermon 24 : How God saved Kenya from chaos

By Blamuel Njururi, Kenya Confidential Editor-in-Chief, Nairobi February 18, 2018

God is said to work in mysterious ways and on the eve of Raila Amolo Odinga swearing in ceremony the Anglican Church of Kenya Archbishop The Most Reverend Dr. Jackson ole Sapit appealed to the Kenya government to allow the ceremony to proceed as planned uninterrupted – and that was God’s will to avert chaos and bloodbath.

Our sermon this Sunday discloses the intricacies that dogged last year’s General Election on August 8, 2017 and the repeat Presidential election on October 26, 2017 explaining how close Kenya was to a catastrophic chaos of unimaginable magnitude save for God’s intervention

Chief Justice David Maraga and Justice Isaac Lenaola are some of the “smartest” lawyers in Kenya today and having reached the peak of their career at Supreme Court, in late 2016 they decided that they were too smart and intelligent to serve in a government led by President Uhuru Kenyatta and William Ruto who they felt were their intellectual juniors.

After several secret meetings they hatched a plan to make the Judiciary the superior arm of Government in Kenya and force the other two arms – the Executive and Parliament – into submission under them.

Parliament would be easy since Kenyans already had a very low opinion of elected politicians and all the judiciary would need was to allow the inherent greed of parliamentarians to grow the perception that this was a junior arm to the Judiciary. They would also send word out to other judges to allow parliament get whatever it wanted so as to annoy the public. That was well calculated since MPs consider public funds as Manna from taxpayers.

Using their foot soldier in the High Court Justice George Ndunga they allowed parliament to reverse the Salaries Review Commission (SRC) laws on salaries, get car grants the current crop of MPs are winning every case filed against them. As calculated that made Kenyans fed up of Parliament and most members of the public don’t take them seriously any more.

After kicking Parliament out from public favour and goodwill, the next plan was to undermine the executive. This was going to be a lot harder – and they would need help. Help that would come from God if their conspiracy was desirable for their motherland Kenya. But as events would unfold, theirs was evil conspiracy against a nation that believes in God’s guidance and worship’s Him for peace and tranquility upon their Nation.

They first co-opted the civil society to ensure there is formation of a coalition to ‘check’ government excesses. The responsibility to manage this sector was given to Deputy Chief Justice Phelomena Mwilu who they co-opted into their scheme, though the two didn’t tell her the whole plan as they did not think she could keep it confidential from Senator Amos Wako, alleged to have assisted her in a case of Jubilee Insurance Ksh 20 million theft and National Assembly Speaker Justin Muturi with whom she has two children. But they kept her close enough for when they would need numbers on the Supreme Court bench – and she played ball.

Once the NGO fraternity was in play they then reached out to the opposition through Senator James Orengo the legal adviser to Raila. They co-opted the opposition into the conspiracy using the argument that Jubilee had gone rogue and was bad for Kenya – and that only the Judiciary stood in the way of a complete dictatorship. They told them they wanted to cause a constitutional crisis that would ensure only a coalition government of Jubilee and CORD/NASA would govern Kenya. This was an easy argument to sell to an outfit that was sure it could not make it to government through elections.

They then got the Non Governmental Organisations (NGOs) and the Opposition NASA into a working partnership, and encouraged them to bring cases and politically attack and undermine strategically all those institutions necessary for security of the elections; starting with the IEBC and including the police, treasury, and even the military. This concerted attack against the electoral process was carried out with alarming success.

On 1st September 2017 Supreme Court then nullified the presidential election despite the fact that Uhuru Kenyatta had won clearly but admitted falsified documents and invoked vague irregularities and illegalities whose fingerprints could not be found. Raila had not even seen the need to petition but Maraga personally guaranteed him that they would ensure Uhuru’s victory was overturned.

He advised Raila against praying for a vote recount knowing full well Uhuru would emerge victorious. However, even Raila was shocked at the decision Supreme Court gave. He had ran out of money and his financier Jimi Wanjigi had directed NASA to force a coalition government after squandering billions he had given NASA.

The trio of Maraga, Lenaola and Mwilu immediately became heroes – especially to Raila followers. However it also made them some very powerful enemies around Uhuru, but these they believed they could deal with once they forced Uhuru into a coalition government with Raila. That explains Kalonzo Musyoka threats of turning Kenya into Somalia, South Sudan and Syria if no dialogue was forthcoming.

The whole idea behind nullification was to force Uhuru to react negatively in anger. They expected him to refuse to accept the court decision and even prepped Raila on what to do to rally the country against Uhuru which included mass action which had the support of the courts. This would then result in violence against the state, and a Constitutional crisis they needed would kick in.

Once the country got into crisis the civil society would step in with calls for dialogue which would immediately be taken by the international community. This would lead to a coalition government, with the Judiciary at the top of the food chain of power in Kenya. Maraga would be ‘First Among Equals’ as regards power dynamics in the country with the President forced to follow his instructions to sustain his mandate as Head of State, with Raila as Prime Minister with a great debt to Maraga as the attack dog whenever Uhuru would fail to play ball.

It was Machiavelli at his finest!

Uhuru then took the unprecedented step of following the Supreme Court order rather than reacting angrily and as planed by the conspirators. Maraga and Mwilu panicked. However Lenaola advised that all wasn’t lost; according to him, if the repeat election did not happen, a Constitutional crisis would still follow. Lenaola then reached out to Raila and advised him to boycott the repeat election.

He also advised Raila to get more money from Jimmy Wanjigi to facilitate the civil society and his opposition troops to start a war against Wafula Chebukati to have him and some commissioners quit the IEBC. Rosylin Akombe caved in to the pressure and fled to her second home in United States leaving the opposition selling her biased narrative that IEBC could not conduct a credible election.

Then the second unplanned event happened. Justice Mativo threw a spanner into his boss’s works when he ruled that the repeat election was open to all candidates who had run in August. This immediately made Raila’s boycott inconsequential to the repeat election. Raila realised he had committed political suicide and as he chocked he stuck to earlier observations by Chebukati that it would be impossible to hold free and fair election if violence provoked by Raila goons persisted.

The IEBC chair had later been assured by security agencies that law would be maintained and he agreed repeat the presidential election would proceed as planned. That was the case in most parts of Kenya except Raila’ s Luo Nyanza and isolated Ukambani and Coastal areas with large Kamba population.

Maraga and Lenaola then decided to seek whatever other avenues they could to have the repeat election postponed. Their believe was such move would heighten national tension and trigger chaos, which would pressurize Uhuru into submission and finally force him into dialogue with NASA. They reached out to the NGOs to file a case challenging IEBC preparedness.

They turned Chebukati into a political captive forcing him to say they in the electoral body weren’t ready. Then they advised Raila to unleash his troops to the streets immediately they made the ruling, to demand for Uhuru to resign which would force Uhuru to reach out for a coalition government.

To Maraga and Lenaola this was no longer a strategy to take over power. They were now fighting for their lives and careers. If they failed Uhuru would hang them. He knew what they had done, and had even publicly called them ‘wakora’. Maraga and his co-conspirators in judiciary had betrayed public trust in pursuit of political favours and perhaps with some economic consideration.

All the cards were ready.

The ruling was to happen on 24th October – 2 days to the repeat election. It was meant to be a devastating blow to Jubilee. It would show Uhuru – who had been out campaigning for the 26th election as impotent and at the mercy of the judiciary. It would show a triumphant Raila, who had insisted and publicly proclaimed that there would be no election on October 26th. The despondency that would engulf the Jubilee support base would be the last straw that would force Uhuru to the negotiating table on power-sharing agenda.

The government tried to stop the Judiciary from sitting to take this decision by first making 24th October a public holiday. Maraga, in open demonstration to show considered himself – and the Judiciary superior to the executive – countermanded the Executive and instructed that courts would operate despite the fact that the Executive had declared the day a public holiday.

However this show of might by Maraga triggered moves to discourage the Supreme Court members not to sit and indeed, on 24th October, 2017 only Maraga and Lenaola were available. Supreme Court had no quorum and could therefore not sit. The conspiracy to stop the elections collapsed flat on its face. Maraga offered the meek excuses that Mwilu was traumatised by an attack on her driver two days earlier and Justice Njoki Ndungu could not make it to Nairobi from undisclosed place. Justice Smoking Wanjala’s whereabouts were unknown and Justice Mohamed Ibrahim was recuperating from undisclosed illness.

On the eve of the repeat election foot soldier Judge George Odunga ruled that the gazettement of Returning Officers and their deputies by the Independent Electoral and Boundaries Commission for the repeat election was irregularly done. It took a night session of a Court of Appeal to overturn the judgment.

The entire Maraga/Lenaola conspiracy plan started unraveling when the repeat elections actually happened. Even the desperate efforts by Raila to unleash his supporters to sabotage elections in his strongholds could not save the situation. The elections happened. The results came in with Uhuru now literally unchallenged by law and the Constitution. Maraga and Lenaola could do nothing but confirm Uhuru’s election. But they still wished against hope that NGOs could fire the last salvo.

Before Uhuru was sworn in Kenya Human Rights Commission (KHRC) Executive Director David Kerogo called on Chebukati to resign and disband IEBC over its conduct of Agust 8thand October 26th elections. The same elections that produced thousands of MCAs, MPs, Senators, Women Representatives and Governors happily drawing taxpayers sweat without KHRC’s concern. Kenya’s NGOs ability to speak from both sides of their mouths is incredibly difficult to fathom save for the fact that some of the leaders will bend backwards to lick their foreign masters boots shamelessly.

On 28th November 2018, as Uhuru Kenyatta and David Maraga stood before millions of Kenyans during Uhuru’s inauguration, both men knew they had been in a war, and one of them had lost. Uhuru was now firmly in office; legally and without challenge. Raila’s troops argument about legitimacy of Uhuru election because of low turn out had no judicial or Constitutional merit.

But Maraga was not done yet!

To appease the devils that may be, the Conspirators prodded Raila to declare himself as President in what they considered a stroke of luck that would finally trigger unprecedented slaughter of innocent Kenyans during the swearing in ceremony at Uhuru Park an invite international intervention. Even when the County government announced it had closed Uhuru Park for renovations and Nairobi Business Community (read Muungiki) said it had booked the venues for youth circumcision counseling, NASA maintained it first option for the ceremony was Uhuru Park, second option Uhuru Park and third option Uhuru Park. Maraga and his Judiciary waited in baited anxiety and anticipation for the big day.

The swearing event on January 30th coincided with an African Unity meeting in Addis Ababa, that Uhuru was attending and which to NASA was a blessing in disguise since it would offer a golden opportunity for Raila supporters march 3 kilometres to take over State House and install him. The conspirators had hoped that trigger happy Kenya Police would block the ceremony creating a confrontation with Raila supporters in which innocent Kenyans would be indiscriminately killed by NASA goons and police.

The massacre would have invited the Kofi Annans of this world and western powers who all along treated Raila as their bosom democratic darling despite his attempt to overthrow President Daniel arap Moi four year government in 1982 when 1,500 innocent Kenyans were killed along with pursuant millions of economic damage. Raila would again call for mass action in 2008 after losing election to Mwai Kibaki in which 1,500 Kenyans lost their lives and billions of economic damage inflicted upon the struggling Kenyan economy.

God is said to work in mysterious ways and on the eve of Raila Amolo Odinga swearing in ceremony the Anglican Church of Kenya Archbishop The Most Reverend Dr. Jackson ole Sapit appealed to the Kenya government to allow the ceremony to proceed as planned and uninterrupted – and that was God’s will to avert chaos and bloodbath. Many skeptics thought Sapit did not comprehend Raila’s ability to create chaos given his violent history of militancy politics.

Many thought that Raila would ask his supporters to march to State House after being sworn in but as it is said man plans and God executes. The anticipated chaos never came to pass. Security forces were withdrawn from Uhuru Park literally pulling the carpet under Raila’s feet and denying him any opportunity for confrontation with police as planned

Raila was sworn in as so-called people’s president and left Uhuru Park without any incident at all and beyond all expectations in God’s name the forces of evil were defeated by the forces of Good. He soon after posted a message to his supporters on his FaceBook thanking them and telling them that the journey he promised to take them to Canaan had been achieved.

Raila is today cruising on Kenya’s political superhighway towards a destination known as an epitaph in a history chapter by which he will be remembered as a frustrated Luo politician who devoted his life to destroying his motherland by hook or crook in pursuit of an allusive seat of the Presidency. Raila’s dilemma supports the argument that Luopeans live in an imaginary world of fantasy where no sane mind would dare to venture into.

Maraga has yet to utter a word against the unconstitutional Raila swearing as his judicial officers enjoy a field day accusing the Executive of disobeying Court orders issued to support a self-declared Nyanza Resistance Movement (NRM) “general” with guts to describe the President as “public enemy number one”, deputy president as “public enemy number two” and interior cabinet secretary as “public enemy number three”. The same rebel said he was organizing for bonfires to burn presidential portraits. Such utterances to judges in Kenya’s Judicially do not pose any security threats to the country that would also affect judiciary operations.

Let us carefully consider weighty and solemn words in Paul’s conclusion to his magnificent Epistle to the Romans.

Watching Out for Wolves

Verse 17 Now I urge you, brethren, keep your eye on those who cause dissensions and hindrances contrary to the teaching which you learned, and turn away from them. 18 For such men are slaves, not of our Lord Christ but of their own appetites; and by their smooth and flattering speech they deceive the hearts of the unsuspecting. 19 For the report of your obedience has reached to all; therefore I am rejoicing over you, but I want you to be wise in what is good, and innocent in what is evil. 20 And the God of peace will soon crush Satan under your feet. The grace of our Lord Jesus be with you.

Paul’s intention throughout this epistle has been to carefully expound the truth of the gospel and to explain its practical implications and obligations. Early in the epistle he alluded to those who would encourage others to live in a way that offends the righteousness of God:

And just as they did not see fit to acknowledge God any longer, God gave them over to a depraved mind, to do those things which are not proper, being filled with all unrighteousness, wickedness, greed, evil; full of envy, murder, strife, deceit, malice; they are gossips, slanderers, haters of God, insolent, arrogant, boastful, inventors of evil, disobedient to parents, without understanding, untrustworthy, unloving, unmerciful; and, although they know the ordinance of God, that those who practice such things are worthy of death, they not only do the same, but also give hearty approval to those who practice them (Romans 1:28-32).
